Terms of Use and Privacy Policy

【Important Hint】

Please read and understand all the rights and restrictions specified in the User License Agreement (hereinafter referred to as "this Agreement") before you start using the Peck series products (hereinafter referred to as "this product"). Peck Technology Co., Ltd. (hereinafter referred to as "Peck" or "we") has always respected and strictly protected the legitimate rights and interests of users (including user privacy, user data, etc.) from any infringement.

This product includes, but is not limited to, Peck Hardware, Peck Software, and its related products, all developed by Peck. The relevant intellectual property rights in this product (including all copyrights, patents, trademarks, etc. of this product) belong to Peck.

This Agreement (including the Privacy Policy at the end of this document) is the final, complete, and exclusive agreement between users (including natural persons, legal persons, or other organizations that have obtained this product through various legal channels, hereinafter referred to as "Users" or "You") and Peck regarding matters related to this product, and replaces and takes precedence over any prior discussion and agreement between the parties on the above matters.

This Agreement will be legally binding on the user's use of the product, and you have undertaken and warranted that you have the right and ability to enter into this Agreement. Your use of this product is deemed to mean that you have accepted this Agreement.

Please read and understand the terms of this Agreement carefully, including the exemption and exclusion of Peck's liability and the restrictions on the user's rights (a minor should be accompanied by a legal guardian during review). If you cannot accept all the terms of this Agreement, please do not start using this product.

1. Use

1.1 Account

Users do not need to create an account to use this product. If you want to use more features of this product, you will need to register a Peck account and provide relevant personal information on the registration page. You must promise and guarantee that:

  • 1.1.1 All registration information submitted by you must be true and accurate;
  • 1.1.2 Your use of this product must be legal;
  • 1.1.3 You can terminate your account at any time by following the instructions for using the Peck account. This product will retain or terminate your account in accordance with Section 5 of this Agreement.

You must promise to keep your login information confidential and not allow it to be used by others, and you are responsible for all actions you perform under the account on this website. You must notify this product of any unauthorized use or suspected unauthorized use of the product at the first opportunity. This product is not legally liable for damages caused by your failure to comply with the above requirements.

1.2 Network Acceleration and Fault Detection Service

During the use of this product, there are some usage scenarios in which this product will check some of your network access behavior during the use process after obtaining your consent. This is designed to help you speed up your network and perform fault detection services when necessary.

This test is done entirely by the software program. There is no human monitoring; it merely uses the relevant software program to match and guide you to open the corresponding third-party content or page. We are committed to ensuring that your privacy during the use of this product will not be disclosed.

2. End User Agreement

2.1 Licensing

Under this Agreement, this product grants you the following non-transferable, non-exclusive license:

  • 2.1.1 The right to use this product;
  • 2.1.2 The right to download, install, and use this product on all your network communication devices, computer devices, and mobile communication devices.

2.2 Restrictive Terms

The authorization granted to you under this Agreement is subject to the following restrictions:

  • 2.2.1 You may not license, sell, lease, transfer, distribute, or otherwise commercialize the product in any form;
  • 2.2.2 Unless such restrictions are prohibited by law, you may not modify, translate, adapt, merge, exploit, disassemble, modify, reverse compile, reverse engineer, etc., any part or derivative of this product;
  • 2.2.3 You may not use the product for the purpose of creating the same or a competitive service;
  • 2.2.4 You may not produce, copy, distribute, sell, download, or display any part of this product in any form or by any means, except as expressly provided by law;
  • 2.2.5 You may not remove or destroy any copyright notices or other proprietary marks contained in this product.

2.3 Ownership of Rights

  • 2.3.1 Peck authorizes you to use and download this product;
  • 2.3.2 Peck (and its "authorizer", if any) owns all relevant intellectual property rights in this product.

2.4 Fees

You must bear the cost of using this product at your own expense, such as communication fees, information fees, etc., collected by individuals or third parties (including but not limited to telecommunications or mobile communication providers). If telecom value-added services are involved, we recommend that you confirm the related cost issues with the value-added service provider.

2.5

Any updates or future versions, updates, or other changes to this product will be governed by this Agreement.

3. User Content

  • 3.1.1 User Content means all content (such as your information, pictures, music, or other content) that is generated when the user downloads, publishes, or otherwise uses the product.
  • 3.1.2 You are the sole responsible person for your User Content, and you assume the risk that you or any third party will be identified as a result of the disclosure of your User Content.
  • 3.1.3 You agree that your User Content is subject to Section 4.

3.2 Feedback

  • 3.2.1 Your suggestion (or "feedback") to Peck is deemed to be your sole right to transfer the "feedback" to Peck, and you agree that Peck has the right to use this feedback and its related information in any reasonable manner. We will treat such feedback as non-confidential and non-proprietary;
  • 3.2.2 You agree that you will not provide Peck with any information that you consider to be confidential and proprietary.

3.3

We reserve the right (but not the obligation) to review the content shared by users based on our judgment. We reserve the right to delete and move your user-shared content at any time, for any reason, whether notified or not. We reserve the right to retain or terminate your account in accordance with Section 5.

4. Rights Restrictions

4.1

You agree to use the related services in this product by sharing or otherwise, and in the course of your use, you will bear all legal liabilities arising from the risks caused by the following actions:

  • 4.1.1 Undermining the basic principles established by the Constitution;
  • 4.1.2 Endangering national security, revealing state secrets, subverting state power, and undermining national unity;
  • 4.1.3 Damaging national honor and interests;
  • 4.1.4 Inciting ethnic hatred and ethnic discrimination, and undermining national unity;
  • 4.1.5 Destroying national religious policy and promoting cults and feudal superstitions;
  • 4.1.6 Disseminating rumors, disrupting social order, and undermining social stability;
  • 4.1.7 Disseminating obscenity, pornography, gambling, violence, murder, terror, or abetment;
  • 4.1.8 Insulting or slandering others and infringing on the lawful rights and interests of others;
  • 4.1.9 Containing other content prohibited by laws and administrative regulations.

4.2

You agree not to engage in the following activities in this product:

  • 4.2.1 Publishing or sharing software such as computer viruses, worms, malicious code, or programs that vandalize or alter computer systems or data;
  • 4.2.2 Collecting information or data of other users, such as email addresses, etc., without authorization;
  • 4.2.3 Maliciously using the product in an automated manner, causing an excessive burden on the server, or otherwise interfering with or damaging the web server and network links;
  • 4.2.4 Attempting to access the server data or communication data of the product without authorization;
  • 4.2.5 Interfering with or damaging other users' use of this product.

5. Modification and Termination

5.1 Modification

  • 5.1.1 This Agreement allows for changes. In the event of any material changes to this Agreement, we will notify you by email or by posting an announcement on the official website of the product (http://www.peiko.net). By continuing to use the product after the change notice, you are deemed to be aware of such changes and to agree to be bound by the terms.
  • 5.1.2 Peck reserves the right to modify, retain, or close any of the Services at any time without notice.
  • 5.1.3 You agree that Peck is not liable to you or any third party for any modification, retention, or closure of any of the Services.

5.2 Termination

  • 5.2.1 This Agreement is effective as of the date of your acceptance and continues to be valid in the course of your use of the product until terminated in accordance with this Agreement;
  • 5.2.2 Notwithstanding the foregoing, if you use this product earlier than the time you accept this Agreement, you hereby acknowledge and agree that this Agreement will be effective from the first time you use the product, unless terminated earlier in accordance with this Agreement;
  • 5.2.3 We may reserve your right to use this product or the account of this website in accordance with the law; we may terminate this Agreement at any time for any reason, whether or not notified, including in the good-faith belief that you have violated our acceptable use policy or other provisions of this Agreement;
  • 5.2.4 Subject to the provisions of the preceding paragraph, Peck reserves the right to terminate this Agreement if the user infringes the copyright of a third party and Peck receives notice from the copyright owner or the legal representative of the copyright owner;
  • 5.2.5 Upon termination of this Agreement, your right to use the product is terminated. You should be aware that the termination of your use of the product means that your User Content will be removed from our active database. Peck does not assume any responsibility for your termination of this Agreement, including the termination of your user account and the deletion of your User Content.

6. Third Parties

6.1

You acknowledge and agree that some of our services are obtained based on third-party technical support. You are aware that this Agreement is between you and Peck and not between you and the above third parties. Peck is the sole actor responsible for the content, maintenance, support services, warranties, and litigation arising from this product. You agree to abide by and authorize the Service to limit your use of the Service to the conditional use of the product.

6.2 Third-Party Information and Services

  • 6.2.1 This product contains some information and services from third parties. Peck does not control and is not responsible for third-party information and services.
  • 6.2.2 Peck provides such information and services only for your convenience or for the purpose of providing and guaranteeing the needs of third parties.
  • 6.2.3 The user is responsible for the risks arising from the use of third-party information and services.
  • 6.2.4 Third-party terms and policies apply when users access third-party information and services.

6.3 Other Users

  • 6.3.1 This product contains user content provided by other users. This product does not control and does not assume legal responsibility for user content. This product has no obligation to inspect, monitor, approve, endorse, promise, or guarantee user content. You must be legally responsible for the risks associated with the use of User Content and interaction with other users.
  • 6.3.2 User interaction with other users is only between you and other users, and this product does not assume any legal responsibility for such behavior. You agree that this product is not legally responsible for the results of such interactions.

7. Compensation

7.1

You agree to use the product harmlessly to protect Peck from any complaints, litigation, loss, damage, liability, costs, and expenses (including attorneys' fees) from third parties arising from the following acts or related actions:

  • 7.1.1 The user's behavior in using the product;

  • 7.1.2 The user's User Content;

  • 7.1.3 The user's violation of this Agreement.

  • 7.2 Peck reserves the right to exclusive defense and claim for compensation.

  • 7.3 You agree that you may not unilaterally settle a lawsuit you file against Peck in connection with a third party, except with the written consent of Peck.

  • 7.4 Peck will use reasonable efforts to notify you of any such action, lawsuit, or process.

  • 7.5 Under no circumstances will this product be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages arising out of this Agreement to you or any third party. The risk of damage to the computer system or mobile communication device database generated by accessing and using this product is at your own risk.

8. Disclaimer

8.1

This product does not assume any legal liability if:

  • 8.1.1 Your personal information is provided in accordance with legal requirements or the requirements of relevant government departments;
  • 8.1.2 Any personal information is disclosed due to your improper use;
  • 8.1.3 Any interruption, obstruction, etc., caused by hacker attacks, computer virus intrusion, illegal content information, harassing information, government regulations, or any other network, technology, communication line, or information security management measures cannot meet user requirements;
  • 8.1.4 The user's communication line failure due to a third party such as an operator, technical problems, network, computer failure, system instability, and other losses caused by force majeure;
  • 8.1.5 The risks associated with the use of information that may be threatening, defamatory, offensive, or illegal by others who may be anonymous or impersonated within the product;
  • 8.1.6 This product expressly states that the timeliness, safety, and accuracy of the service of this product and its partner companies are not guaranteed, whether express or implied and in any form.

8.2

If the following situations occur during the use of the smart scene, the product does not bear any legal responsibility:

  • 8.2.1 Anyone who creates an intelligent scene in any way is deemed to have accepted this statement voluntarily.
  • 8.2.2 This function is currently in the experimental stage and is only for experience exchange. The defects that may be generated by this function will be gradually corrected by software upgrade. I have no objection to the other content.
  • 8.2.3 The company does not assume any responsibility for the intelligent scenario caused by, but not limited to, hacker attack, network interruption, network delay, equipment offline, etc., but will try its best to reduce the loss or influence caused to the user.
  • 8.2.4 The company does not assume any legal responsibility for any loss caused by improper use of this function by users.

9. Privacy Policy

The Peck Series Product Privacy Policy is part of this Agreement and can be found at the end of this article. Please read and understand all the contents of the privacy policy carefully.

10. Notification

  • 10.1 The user must provide a valid email address that you have recently used in the Peck account. This product is not responsible for the risk that the email address you provided cannot be used or that we are unable to deliver the notice to you for any reason.
  • 10.2 Notices of announcements posted by this product and emails sent to you containing such notices undoubtedly constitute valid notice.

11. Applicable Law

  • 11.1 This Agreement applies the laws of the People's Republic of China.
  • 11.2 If there is a dispute between the two parties, it should be settled through consultation on the basis of friendly principles; if the negotiation fails, the lawsuit should be filed in the court where Peck is located.

12. Independence

Certain provisions of this Agreement may be inapplicable for any reason; the other terms of this Agreement will continue to apply, and the inapplicable terms will be modified so that they can be applied in accordance with the law.

13. Integrity

  • 13.1 This Agreement (including the Privacy Policy) is the final, complete, and exclusive agreement between you and the product regarding the product, and supersedes and merges the parties' prior discussions and agreements on such matters (including the prior End User License, Services terms, and Privacy Policy).
  • 13.2 The title of each part is for reading only, without any legal or contractual obligations.
  • 13.3 You may not assign the rights and obligations set forth in this Agreement unless Peck's written consent is obtained. Any attempt to transfer in violation of the above provisions is void.

Peck Series Privacy Policy

You can use our services in a number of different ways, such as accessing Peck's official website to purchase Peck's smart hardware products, using Peck software on different terminals and services, and more.

If you share information with us (for example, by creating a Peck account), we can provide you with better services, such as showing more relevant product updates and ads, helping you connect with others, or sharing content with others more quickly and easily.

For this purpose, we will explain to you how we collect and use the information and how you can protect your privacy.

Our privacy policy covers the following areas:

  • What information we collect.
  • How we collect and use information.
  • How you can selectively provide this information and how to access and update it.

When you create a Peck account, download and update Peck software, register at a Peck online retail store, participate in an online survey, or participate in other interactions with Peck Technologies, we will ask you to provide personal information, including but not limited to your name, phone number, email address, mailing address, etc.

When you purchase Peck products and services, we collect personal information, including but not limited to: delivery details, bank account numbers, credit card details, billing addresses, credit checks, and other financial information, contacts, and communication records.

When you use Peck products to share your content, send messages and products with family and friends, or invite others on the Peck Forum, Peck collects personal information about you, such as your name, mailing address, email address, and phone number, etc.

When you first use and activate your Peck device, your mobile user identification, mobile device unique identifier, and approximate geographic location information for your device will be sent to Peck.

The collection of the above information may also apply to situations in which you update your system or software, restore factory settings, and so on.

Our Privacy Policy does not apply to third-party products and/or services. Third-party products and services may be included in the Peck range of products and services.

When you use third-party products or receive third-party services, they may obtain your information, so we remind you to read the third-party privacy policy.

At the same time, this Privacy Policy does not apply to the collection of data on external websites after you click on a link.

Collection and Use of Children's Personal Information

We recommend that children under the age of 13 use Peck products or services with the permission and guidance of their legal guardian.

Peck will not collect personal information when it knows that the other party is a child, nor will it disclose its personal information to any third party.

The guardian has the right to refuse to allow Peck and its affiliates to further collect the personal information of the ward, or to ask Peck and its affiliates to delete the personal information of the ward.

If we find that we have collected personal information from children under the age of 13, we will take steps to remove this information as soon as possible.

Amendments to This Privacy Policy

This Privacy Policy allows for adjustments, and we will not diminish your rights under this Privacy Policy without your express consent, unless we send a notice or post a website announcement through the email address you provided.
